Welcome to The Nest Family Center. These Terms of Service explain the rules that apply when you access or use our website, booking platform, payment tools, forms, communications, and related services.
The Nest Family Center LLC is a New Hampshire licensed child care facility located at 25A Orchard View Dr., Londonderry, NH 03053. We can be contacted at hello@thenestfamilycenternh.com.
By using our website (thenestfamilycenternh.com), submitting an application, creating an account, enrolling a child, purchasing a membership, booking care, making a payment, or using WingBook or any related booking/payment tools, you agree to these Terms.
These Terms are intended to govern use of our website, WingBook, online forms, online payments, and related digital services. Your family’s enrollment agreement, signed forms, handbook, licensing requirements, health and safety policies, and written communications from The Nest Family Center may include additional rules that apply to child care services. If there is a conflict between these Terms and a signed enrollment agreement or legally required child care policy, the signed agreement or legally required policy will take precedence.
1. Who May Use Our Services
Our website, forms, payment tools, and WingBook accounts are intended for adults who are at least 18 years old and who are legally authorized to act for the child or family account.
By using our services, you confirm that:
You are at least 18 years old.
You have authority to submit information for yourself, your child, and any emergency contacts, authorized pickups, family members, or payers you add to your account.
The information you provide is accurate, complete, and current.
You will promptly update your information if anything changes, including contact information, emergency contacts, medical information, allergies, authorized pickups, custody restrictions, billing information, and child care needs.
2. Our Child Care Model
The Nest Family Center provides licensed child care services in Londonderry, New Hampshire. Our model may include flexible hourly care, consistent care, full-time care, recurring monthly memberships, application and enrollment workflows, online booking, online payments, medical document collection, attendance tracking, family communication, and related services.
Care is subject to licensing rules, staffing, classroom capacity, age-group availability, required documentation, health and safety policies, payment status, and administrative approval.
Submitting an application, creating an account, joining a waitlist, using the estimator, booking a tour, or communicating with us does not guarantee enrollment, a start date, a specific classroom, a specific schedule, or future availability.
3. Applications, Enrollment, and Approval
Families may be required to complete an application, enrollment packet, medical documentation, payment setup, and any other required forms before care can begin.
Enrollment is not final until The Nest Family Center confirms approval and any required deposit, payment, forms, medical records, and administrative steps have been completed.
We reserve the right to approve, deny, pause, or withdraw enrollment based on availability, licensing requirements, staffing, classroom fit, incomplete documentation, unpaid balances, safety concerns, or failure to comply with our policies.
4. Required Child Information and Medical Documentation
Because we are a licensed child care facility, we may require information and documentation relating to your child’s identity, age, health, immunization status, allergies, sensitivities, medical conditions, medications, physical exam dates, treatment plans, emergency contacts, authorized pickups, and other information necessary to provide safe care and comply with applicable rules.
You are responsible for ensuring that child records are accurate and up to date.
You must notify us promptly of any changes to your child’s health, allergies, medication needs, dietary restrictions, custody arrangements, authorized pickups, or emergency contacts.
We may refuse or pause care if required documentation is incomplete, expired, missing, inaccurate, or insufficient for us to safely care for your child or comply with licensing requirements.
5. Immunization, Health, Allergy, and Medication Requirements
The Nest Family Center requires families to comply with our immunization, health, allergy, medication, and safety policies.
If your child has an allergy, sensitivity, medical condition, medication need, or treatment plan, you must provide all required documentation before care can begin or continue.
Medication may only be accepted, stored, or administered if all required authorization forms and supporting documentation have been completed and approved.
We reserve the right to decline care, pause care, or require updated documentation when needed for the safety of your child, other children, staff, or the center.
6. WingBook and Online Booking
WingBook is our booking and account management application. Through WingBook or related tools, families may view account information, purchase or manage memberships, book care, manage hours, update family information, submit forms, view invoices, or communicate with The Nest Family Center.
Bookings are subject to availability, staffing, ratios, classroom capacity, age group, licensing requirements, account status, and center approval.
A booking is not guaranteed unless it is confirmed in the system or by The Nest Family Center.
We may modify, decline, cancel, or restrict bookings if needed for safety, licensing, staffing, payment status, documentation, classroom capacity, illness policy, weather closure, emergency closure, or other operational needs.
You are responsible for reviewing your bookings and notifying us promptly of any errors.
7. Booking Rules
The Nest Family Center may set booking rules, including minimum booking lengths, booking increments, booking windows, absence rules, nap-time pickup restrictions, drop-off and pickup times, availability limits, and other operational requirements.
Current booking rules may include top-of-hour booking, minimum booking blocks, advance booking limitations, absence reporting deadlines, and classroom-specific scheduling rules. These may change from time to time.
We may publish booking rules on our website, in WingBook, in enrollment materials, or in direct communications with families. You agree to follow the current booking rules in effect at the time care is requested or provided.
8. Memberships, Hours, and Subscriptions
The Nest Family Center may offer recurring membership plans, hourly care plans, consistent care plans, flex care plans, combined care plans, full-time plans, or other subscription-based services.
Memberships may include a set number of monthly hours, guaranteed schedule blocks, flexible booking privileges, administrative fees, diaper/wipe add-ons, meal-related charges, discounts, or other plan features.
Membership terms, pricing, included hours, booking rights, rollover rules, expiration rules, and restrictions may vary by plan.
Unless otherwise stated in writing, membership hours do not roll over after the applicable billing cycle.
The Nest Family Center may change plan names, rates, fees, hours, discounts, booking rules, or plan availability. We will communicate material changes as required by applicable law or via our written policies.
9. Payments and Billing
You agree to pay all charges associated with your application, deposit, membership, bookings, fees, add-ons, late pickups, returned payments, payment processing fees, or other purchases.
Payments may be processed through Stripe or another payment processor. By submitting payment information, you authorize us and our payment processors to charge your selected payment method for amounts owed.
You agree to keep your payment information current and valid.
If your payment method fails, we may retry the charge, request updated payment information, suspend booking privileges, pause care, assess applicable fees, or take other steps permitted by our policies and applicable law.
Payment processors may store and process your payment information according to their own terms and privacy policies. The Nest Family Center does not directly store full credit card numbers.
10. Deposits
The Nest Family Center may require a deposit to hold a start date, schedule, membership, classroom slot, or enrollment opportunity.
Unless otherwise stated in writing, a deposit is applied toward the first month of care or membership charges.
Because deposits are used to determine capacity, staffing, and schedule availability, deposits may be non-refundable once a start date, schedule, or spot is held for your family.
Deposit terms may vary by enrollment offer or written agreement. The terms provided with your deposit invoice or enrollment communication will take precedence.
11. Cancellations, Membership Changes, and Absences
Families are responsible for following The Nest Family Center’s cancellation, membership change, and absence policies.
The Nest Family Center may require advance notice for membership changes, schedule changes, or cancellation of care.
Absence credits, if available, are only provided according to the written policy for your plan and only when all conditions are met.
Consistent Care, full-time, or guaranteed schedule plans may be charged whether or not the child attends, unless otherwise stated in writing.
Failure to attend scheduled care does not entitle you to a refund, credit, or rollover.
12. Refunds
Unless otherwise stated in writing, all sales are final.
Payments, deposits, membership charges, fees, and unused hours are generally non-refundable.
Refunds or credits, if any, are issued only at The Nest Family Center’s discretion or as required by applicable law.
13. Late Pickup, Missed Pickup, and Emergency Procedures
Families must pick up children on time and in accordance with their scheduled booking and our center policies.
Late pickups may result in additional fees, account restrictions, required schedule changes, or termination of care.
If a child is not picked up and we cannot reach a parent or authorized pickup, we may contact emergency contacts and, if necessary, appropriate authorities, consistent with our center policies as well as legal and licensing obligations.
14. Illness, Safety, and Exclusion from Care
The Nest Family Center may refuse or exclude a child from care because of illness, symptoms, missing documentation, safety concerns, behavioral concerns, unpaid balances, emergency conditions, licensing requirements, or other reasons permitted by our policies or applicable law.
Families must follow our illness, medication, allergy, hygiene, and safety policies.
You agree not to bring a child to care if doing so would violate our illness policy or create a safety risk for other children, staff, or families.
15. Closures, Delays, and Service Interruptions
The Nest Family Center may close, delay opening, close early, or modify operations because of weather, power outages, staffing issues, illness outbreaks, building issues, emergencies, licensing directives, public health guidance, or other circumstances beyond our control.
We are not responsible for losses, inconvenience, missed work, backup care costs, or other damages caused by closures, delays, interruptions, system outages, or inability to access WingBook or related services.
Credits, refunds, or schedule adjustments for closures, if any, will be handled according to our written policies.
16. Family Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree not to share your password or PIN codes with unauthorized users.
You agree to notify us promptly if you believe your account has been accessed without authorization.
You may not use another person’s account without permission.
17. Acceptable Use
You agree not to misuse our website, WingBook, payment tools, forms, or communications systems.
You may not:
Use the services for unlawful, fraudulent, abusive, or harmful purposes.
Submit false, misleading, or incomplete information.
Attempt to access another family’s account or data.
Interfere with the security or operation of our systems.
Upload malicious code, spam, or harmful content.
Scrape, copy, reverse engineer, or misuse our software or content.
Harass, threaten, abuse, or intimidate staff, families, children, vendors, or other users.
Share, publish, download, or distribute photographs, videos, or other information containing children other than your own that are obtained through our systems or services.
Use the services in a way that violates any applicable law, licensing rule, enrollment agreement, or center policy.
18. Parent Submissions, Forms, and Uploaded Documents
You may submit information, forms, messages, images, documents, immunization records, health forms, treatment plans, medical authorizations, and other materials through our website, WingBook, email, PandaDoc, Stripe, Famly, or related tools.
You retain ownership of information and documents you submit.
You give The Nest Family Center permission to use, store, review, process, copy, share with service providers, and maintain those materials as needed to provide care, manage enrollment, comply with licensing requirements, process payments, communicate with you, support operations, and protect the safety of children and staff.
You are responsible for ensuring that submitted materials are accurate, lawful, and that you have authority to provide them.
19. Photos, Testimonials, Reviews, and Marketing Content
The Nest Family Center may request reviews, testimonials, photos, videos, or other content from families.
We will use child photos, videos, or identifying child information for marketing only as permitted by your signed permissions, applicable law, and our center policies.
Public reviews, comments, tags, or social media interactions you voluntarily post may be visible to others and may be reshared or referenced by The Nest Family Center where permitted by law and platform rules.
20. Intellectual Property
The Nest Family Center website, branding, logos, copy, graphics, designs, photographs, videos, curriculum materials, policies, forms, software, booking flows, and related content are owned by The Nest Family Center or used with permission.
You may use our website and services only for personal, family, enrollment, booking, and account purposes.
You may not copy, reproduce, sell, license, distribute, modify, or create derivative works from our content or software without our written permission.
21. Third-Party Services
The Nest Family Center may use third-party platforms and service providers, including payment processors, form providers, booking tools, communication platforms, cloud hosting providers, analytics tools, AI-assisted document processing tools, customer management tools, email providers, and other vendors.
Examples may include Stripe, PandaDoc, Famly, Google services, website hosting providers, analytics providers, and AI service providers.
Third-party services may have their own terms and privacy policies. The Nest Family Center is not responsible for the content, policies, practices, outages, or errors of third-party services, except as required by law.
22. AI-Assisted and Automated Tools
The Nest Family Center or WingBook may use AI-assisted or automated tools to help with administrative workflows, such as reading uploaded immunization records, identifying missing form information, summarizing submitted documents, improving booking workflows, supporting customer service, or improving internal operations.
AI-assisted tools are used to support human review and administrative efficiency. They do not replace The Nest Family Center’s responsibility to make enrollment, safety, medical, or licensing decisions.
You are responsible for reviewing information submitted through any automated or AI-assisted workflow and notifying us of errors.
23. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, share, and protect personal information.
By using our services, you agree that we may collect and process information as described in the Privacy Policy.
24. No Guarantee of Error-Free Services
We work hard to provide accurate, reliable services, but we do not guarantee that our website, WingBook, forms, booking tools, pricing displays, account information, document processing, or payment tools will always be error-free, uninterrupted, secure, or current.
We may correct errors, update information, modify features, suspend access, or change services at any time.
If you notice an error in your account, booking, payment, child information, or documents, you must notify us promptly.
25. Disclaimer
To the fullest extent permitted by law, our website, WingBook, forms, online tools, and related digital services are provided on an “as is” and “as available” basis.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation to the extent permitted by law.
Nothing in these Terms limits any rights that cannot legally be limited, including rights under applicable child care licensing rules, consumer protection laws, or other applicable laws.
26. Limitation of Liability
To the fullest extent permitted by law, The Nest Family Center LLC and its owners, directors, employees, contractors, vendors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of our website, WingBook, payment tools, forms, or related digital services.
To the fullest extent permitted by law, our total liability for claims arising from these digital services will be limited to the amount you paid to The Nest Family Center during the six months before the claim arose or $1,000, whichever is less.
This limitation does not apply where prohibited by law.
27. Indemnification
You agree to indemnify and hold harmless The Nest Family Center LLC, its owners, directors, employees, contractors, vendors, and agents from claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:
Your misuse of our website, WingBook, forms, or payment tools.
Information or documents you submit.
Your violation of these Terms.
Your violation of applicable law.
Your violation of another person’s rights.
Your failure to follow our enrollment, booking, payment, health, safety, or child care policies.
Your failure to comply with childcare licensing rules.
28. Suspension or Termination of Access
We may suspend, restrict, or terminate access to our website, WingBook, bookings, payment tools, forms, or services if we believe you have violated these Terms, failed to pay amounts owed, submitted false or incomplete information, created a safety concern, misused our systems, or failed to comply with our policies.
Termination of digital access does not eliminate your responsibility to pay outstanding amounts owed.
29. Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of our digital services will be handled in New Hampshire, unless applicable law requires otherwise.
30. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on our website with a revised “Last updated” date.
Your continued use of our services after updated Terms are posted means you accept the updated Terms.
